These Website Terms and Conditions (Terms) apply to your use of mjselectricalsupplies.com.au (Website) and to orders placed through the Website.

The Website is operated by Kalmarc Electrical Supplies Pty Ltd trading as MJS Electrical Products & Supplies (ABN 21 621 565 526) (MJS, we, us or our).

By accessing or using the Website, you agree to these Terms. When you place an order, you also agree to the version of these Terms displayed at checkout at that time. If you do not agree, you must not use the Website or place an order.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

1. Eligibility to order

You must be at least 18 years old and have legal capacity to enter into a contract to place an order through the Website.

If you place an order on behalf of a business or another person, you confirm that you have authority to bind that business or person to these Terms.

2. Website information

We take reasonable care to ensure that product descriptions, specifications, images, stock information and other Website content are accurate and current. However:

• images may be illustrative, and colours or finishes may appear differently depending on your device;
• packaging and minor product details may change without notice; and
• stock information and delivery estimates may not update in real time.

Where an error affects an order, we will contact you and provide any remedy required by law. Nothing in this section permits us to engage in misleading or deceptive conduct.

3. Product selection and electrical installation

You are responsible for checking that a product is compatible with, and suitable for, your intended application before purchasing it. Where appropriate, confirm your selection with a licensed electrician or other suitably qualified installer before placing your order.

Electrical installation work must be carried out by a person who is appropriately licensed for the work and jurisdiction concerned. We do not provide electrical installation advice through the Website or through staff who are not authorised or qualified to provide that advice.

Improper installation, misuse or unauthorised modification may affect a warranty or remedy to the extent that it caused or contributed to the fault or damage. This does not exclude any rights that cannot lawfully be excluded under the Australian Consumer Law.

4. Orders and contract formation

When you place an order, you make an offer to purchase the selected products for the total price shown at checkout, including applicable delivery charges and taxes.

An automated order confirmation or payment receipt acknowledges that we have received your order. It does not, by itself, mean that we have accepted your offer. A contract is formed when we confirm that the order has been dispatched or is ready for collection, unless we expressly accept the order earlier.

Before accepting an order, we may reasonably request further information or verification. We may decline or cancel an order before acceptance where, for example:

• a product is unavailable;
• we cannot verify payment or delivery information;
• we reasonably suspect fraud or unlawful activity;
• the order breaches a product restriction or these Terms; or
• there is a genuine error in the product description, availability or price.

If we decline or cancel an order after payment has been taken, we will promptly refund the amount paid using the original payment method, unless you agree to another method. Any action we take in relation to a pricing error remains subject to the Australian Consumer Law, including the rules concerning multiple displayed prices and misleading price representations.

5. Prices and payment

Unless clearly stated otherwise, prices displayed to consumers are in Australian dollars and include GST. Any delivery charge or other applicable fee will be disclosed before you place your order.

Prices may change at any time before an order is accepted. A price shown in your cart is not reserved and may change before payment. Once an order has been accepted, its price will not change unless you agree to a change or the law permits it.

You must pay using a payment method offered at checkout. You warrant that you are authorised to use the selected payment method.

Approved trade or credit accounts may be subject to separate written account terms, including agreed payment periods, interest and recovery costs. If there is any inconsistency, the separate account terms apply to the account arrangement, while these Terms continue to apply to use of the Website and the relevant sale to the extent they are not inconsistent.

6. Availability and special-order products

All products are subject to availability. A product described as a special-order, made-to-order, cut-to-length or otherwise customised product is ordered, produced or altered specifically for you.

Special-order and customised products are not eligible for a change-of-mind return unless we agree otherwise in writing. This restriction does not apply where the product is faulty, unsafe, incorrectly described, does not match the order or sample, or where another remedy is required by law.

7. Delivery

Delivery options, available destinations and charges are shown at checkout or advised before your order is accepted. We use Australia Post and other delivery providers depending on the size, weight, destination and nature of the order.

Additional charges may apply to remote-area deliveries, pallet deliveries and large, long, heavy or bulky products. We will disclose any additional charge and seek your agreement before proceeding. If you do not agree, you may cancel the affected order for a full refund.

Any dispatch or delivery timeframe is an estimate only unless we expressly agree to a guaranteed date. Delays may occur because of stock availability, carrier disruption, severe weather or other circumstances outside our reasonable control. We will keep you reasonably informed of a material delay. If we cannot supply the order within a reasonable time, you may be entitled to cancel it and receive a refund.

You must provide complete and accurate delivery information and ensure that someone can receive the order where required. We are not responsible for loss caused solely by incorrect information you provide, but we will take reasonable steps to help resolve delivery issues.

If an order is lost or damaged before delivery, contact us as soon as reasonably possible so we can investigate and provide any remedy required by law.

8. Click and collect

We will notify you when a click-and-collect order is ready. You may be required to provide the order confirmation and suitable identification when collecting the order.

Please do not attend for collection until you have received confirmation that the order is ready. If another person is collecting for you, you must authorise them in advance and they may also be required to provide identification.

9. Title and risk

Ownership of products passes to you when we have received payment in full. Risk of loss or damage passes to you when the products are delivered to the nominated delivery address or collected by you or your authorised representative.

This section does not limit our responsibility for products that are lost, damaged or otherwise fail to comply with a consumer guarantee before risk passes to you.

10. Checking your order

It is the customers responsability to check the products, quantities, cable sizes, specifications and visible condition of your order as soon as reasonably possible after delivery or collection and before installation or use.

If anything is missing, incorrect or damaged, contact us promptly. A request to contact us promptly helps us investigate the issue and does not limit any right or remedy available under the Australian Consumer Law.

11. Change-of-mind returns

In addition to your rights under the Australian Consumer Law, we offer a 30-day change-of-mind return policy subject to this section.

To be eligible, you must request the return within 30 days after delivery or collection. The product must be unused, uninstalled, complete, in resalable condition and returned with its original packaging, accessories and components. Proof of purchase is required.

A 5% restocking fee applies to all approved change-of-mind returns. This includes:

• online and in-store purchases;
• products returned at the counter or through an authorised delivery arrangement;
• orders awaiting collection; and
• orders cancelled after purchase but before dispatch, where the cancellation is not due to our breach or a right available under law.

Original delivery charges are not refundable for a change-of-mind return. You are responsible for the cost and risk of returning the product and should use a tracked and adequately insured service.

The change-of-mind policy does not apply to:

• special-order, made-to-order, cut-to-length or customised products;
• products that have been installed, used, altered or damaged after delivery;
• clearance products clearly marked as non-returnable for change of mind; or
• any product that cannot be safely or lawfully resold after return.

We may agree to an exception at our discretion. This change-of-mind policy does not restrict any rights relating to faulty, damaged, unsafe, misdescribed or incorrectly supplied products.

12. Faulty, damaged or incorrectly supplied products

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. These may include guarantees that products are of acceptable quality, match their description, are fit for any disclosed purpose and correspond with any sample or demonstration model.

If you believe a product is faulty, damaged, unsafe, incorrectly supplied or does not meet a consumer guarantee, contact us as soon as reasonably possible. We may ask for proof of purchase and reasonable information, photographs or testing needed to assess the claim.

You do not need the original packaging to make a claim under the Australian Consumer Law.

Where a product has a major failure, you may reject it and choose a refund or replacement, or keep it and seek compensation for the reduction in value, subject to the Australian Consumer Law. For a minor failure, we may choose to provide a repair, replacement or refund. If we do not remedy a minor failure within a reasonable time, you may have further rights under the Australian Consumer Law.

For products that can be posted or easily returned, you may initially be asked to return the product. If the product is confirmed to have a problem covered by law, we will reimburse your reasonable return costs. For a product that is large, heavy, installed or otherwise difficult to return, we will arrange collection or inspection within a reasonable time where required by law.

If assessment shows that the product has no fault or that the issue was caused by misuse, incorrect installation, unauthorised modification or other circumstances for which we are not responsible, we may decline the claim. If we propose to charge reasonable collection, testing or return costs, we will provide an estimate before those costs are incurred.

13. Manufacturer warranties

A manufacturer or supplier may provide an express warranty for a product. Any such warranty is in addition to, and does not replace, rights under the Australian Consumer Law.

You may contact us about a product problem even where a manufacturer warranty also applies. We may work with the manufacturer or supplier to assess or resolve a claim, but we remain responsible for providing any remedy that you are entitled to obtain from us under the Australian Consumer Law.

14. Website use

You may access and use the Website for lawful personal or business purchasing purposes. You must not:

• use the Website unlawfully, fraudulently or in a way that infringes another person's rights;
• interfere with the Website's operation, security, servers or networks;
• introduce malicious code, viruses or other harmful material;
• attempt to gain unauthorised access to the Website or associated systems;
• scrape, harvest or extract Website data by automated means without our written consent, except as permitted by law; or
• use Website content to misrepresent an association with, or endorsement by, MJS.

We may suspend or restrict access where reasonably necessary to protect the Website, users or our legitimate business interests.

15. Intellectual property

Unless otherwise indicated, the Website and its content, including text, graphics, photographs, videos, logos, trade marks, layout and software, are owned by or licensed to us and are protected by intellectual property laws.

We grant you a limited, non-exclusive, revocable licence to access and use the Website and to download or print reasonable extracts solely for placing an order, managing your account or evaluating products for purchase.

Except as permitted by law or with the relevant rights holder's prior written consent, you must not reproduce, adapt, distribute, publicly display, frame, commercially exploit or create derivative works from Website content.

16. Feedback and submissions

If you voluntarily send us suggestions or feedback, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and adapt that material for our business purposes.

You retain ownership of your material. You confirm that you have the right to provide it and that our permitted use will not infringe another person's rights. This licence does not apply to personal information, which is handled in accordance with our Privacy Policy and applicable privacy law.

17. Third-party websites

The Website may contain links to websites operated by third parties. We do not control those websites and are not responsible for their content, security, availability, products or services.

A link does not necessarily indicate that we endorse the third party. Your use of a third-party website is governed by that party's terms and policies. Nothing in this section limits liability that cannot lawfully be excluded.

18. Privacy

We handle personal information in accordance with our Privacy Policy and applicable privacy laws. Our Privacy Policy explains how we collect, use, disclose, store and protect personal information and how you may request access or correction or make a privacy complaint.

19. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, we are not liable for loss or damage arising solely from:

• your unlawful use of the Website;
• your failure to follow product instructions or safety requirements;
• installation, modification or repair by an unauthorised or unqualified person; or
• events outside our reasonable control that we could not reasonably prevent or overcome.

This limitation does not apply to the extent that the loss or damage was caused or contributed to by our negligence, breach of contract, wilful misconduct or breach of law.

Where the Australian Consumer Law permits us to limit a remedy for goods or services not ordinarily acquired for personal, domestic or household use or consumption, our liability is limited, at our option and only where it is fair and reasonable, to the remedies permitted by section 64A of the Australian Consumer Law.

20. Indemnity

To the extent permitted by law, you indemnify us against third-party claims and reasonable losses directly arising from your unlawful use of the Website, your wilful infringement of another person's rights, or your material breach of these Terms.

Your liability under this indemnity is reduced to the extent that our act or omission caused or contributed to the claim or loss. This section does not require you to indemnify us for our negligence, breach of contract, wilful misconduct or breach of law.

21. Suspension and termination

You may stop using the Website at any time. We may suspend or terminate your Website access where you materially breach these Terms, use the Website unlawfully or create a security risk.

Termination does not affect rights or obligations that accrued before termination. Provisions intended by their nature to continue, including intellectual property, liability and governing law provisions, survive termination.

22. Changes to these Terms

We may update these Terms from time to time by publishing the revised version on the Website. Changes apply prospectively from the stated effective date and do not alter an order already accepted unless you agree or the law permits the change.

We recommend reviewing these Terms before placing an order.

23. Severability and waiver

If any provision of these Terms is held to be invalid or unenforceable, it will be read down to the minimum extent necessary or severed, and the remaining provisions will continue to operate.

A failure or delay in exercising a right does not waive that right.

24. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and MJS submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them.

Nothing in this section prevents a consumer from relying on any mandatory rights relating to jurisdiction or applicable law.
